By Registering for this tournament, you hereby acknowledge that you have read, understand all terms and conditions stated above, and agree to be legally bound by this agreement.
In consideration of being permitted to utilize the facilities, equipment, and/or participate in any programs, services, or activities offered or coordinated by the Attleboro Recreation Department—including but not limited to tennis, archery, water aerobics, swimming lessons, and use of swimming pool or any other program, services or activity (together, the “Summer Programs”) taking place at the Bartek Recreation Center, the neighboring recreation fields, parks, playgrounds, and swimming pools (collectively, the “Bartek Center Facilities”)—the undersigned, on behalf of themselves and their heirs, personal representatives, and assigns, hereby agrees to release, indemnify, defend, and hold harmless the City of Attleboro, including the Attleboro Recreation Department, its committee members, board members, officers, agents, representatives, employees, and volunteers, (together the “City”) from and against any and all claims, suits, demands, actions, causes of action, losses, damages, or liabilities of any kind, nature, or description, including but not limited to claims of negligence, property damage, accident, injury, illness and/or death and including indemnification and payment of any and all litigation costs and attorney’s fees, arising out of or in any way related to the undersigned participating in the Summer Programs at the Bartek Center Facilities,
In addition, the undersigned, understands, acknowledges and agrees to the following:
• Assumption of Risk: Participation in recreational activities and the use of facilities and equipment involve inherent risks, including but not limited to physical injury, property damage, or illness. The undersigned agrees to voluntarily assume all such risks associated with the use of the Bartek Center Facilities and participation in the Summer Programs.
• Release of Liability: The undersigned on behalf of his/her heirs, executors, administrators, release and hold harmless Bartek Center and the City of Attleboro, its employees, agents, volunteers, and representatives from any and all claims, demands, actions, or causes of action related to injury, illness, or property damage arising out of or in connection with my use of the Bartek Center Facilities and participation in the Summer Programs.
• Medical Consent: In the event of an injury or medical emergency, the Bartek Center staff may seek or provide medical treatment for the undersigned or his/her minor child(ren), and the undersigned shall assume responsibility for any and all costs associated with such treatment.
• Facility Rules and Policies: Participants must abide by all rules, policies, and procedures of the Attleboro Recreation Department, including those specific to the Bartek Recreation Facilities. The City may revise these rules, regulations and protocols at any time and at their discretion. Failure to comply with these rules and policies may result in suspension or termination of access to facilities, programs, and/or activities.
