Terms and Conditions for Participation in Big Pickl Events Pickleball Tournaments
1. Acceptance of Terms
By registering for or participating in any Big Pickl Events Pickleball tournament (the "Event"), hosted by Keystone Hoops Group LLC ("Organizer"), participants agree to comply with and be bound by these Terms and Conditions.
2. Assumption of Risk
Participation in the Event involves inherent risks, including but not limited to physical injury, illness, disability, or death. Participants acknowledge that they understand and voluntarily assume all risks associated with participation, including those arising from the negligence of the Organizer or others.
3. Waiver of Liability
To the fullest extent permitted by law, participants hereby waive, release, and discharge the Organizer, its affiliates, officers, directors, employees, agents, sponsors, and volunteers ("Released Parties") from any and all claims, liabilities, or causes of action, whether known or unknown, arising out of or related to participation in the Event, including but not limited to personal injury, property damage, or economic loss.
4. Indemnification
Participants agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, liabilities, damages, expenses, and losses (including reasonable attorneys’ fees) arising out of or related to:
a. Their participation in the Event;
b. Their breach of these Terms and Conditions; or
c. Any acts or omissions that result in injury or damage to others during the Event.
5. Medical Treatment and Emergency Services
Participants authorize the Organizer to provide or arrange for medical treatment in the event of an injury or medical emergency during the Event. Participants acknowledge that they are responsible for all costs associated with such treatment and waive any claims against the Released Parties for the provision or failure to provide such treatment.
6. Insurance
Participants acknowledge that the Organizer does not provide health, accident, or liability insurance coverage for participants. Participants are encouraged to maintain their own insurance to cover any injuries or damages that may occur during the Event.
7. Media Release
By participating in the Event, participants grant the Organizer and its affiliates the irrevocable right to use their name, likeness, voice, and image in any media for promotional or commercial purposes without compensation.
8. Code of Conduct
Participants agree to behave respectfully and responsibly during the Event. The Organizer reserves the right to disqualify or remove any participant who violates the Code of Conduct, endangers others, or disrupts the Event.
9. Force Majeure
The Organizer shall not be held liable for any delay or cancellation of the Event due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, government restrictions, or other emergencies.
10. Severability
If any provision of these Terms and Conditions is deemed unlawful or unenforceable, the remaining provisions shall remain in full force and effect.
11. Governing Law and Dispute Resolution
These Terms and Conditions shall be governed by and construed in accordance with the laws of the state in which the Event is held. Any disputes arising out of or related to these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
12. Acknowledgment and Consent
By registering for or participating in the Event, participants acknowledge that they have read, understood, and agree to these Terms and Conditions. If the participant is under the age of 18, a parent or legal guardian must provide consent.
Important
Participants are required to sign a liability waiver before participating in the Event. Failure to sign the waiver will result in disqualification.
