Release of Liability, Waiver, and Assumption of Risk

• Venue: MVP Holland, Holland, Michigan (the "Venue")
Please read this agreement carefully before signing. By signing, you give up certain legal rights, including the right to sue.
Terms
In exchange for being allowed to participate in the Tommy Turtle Classic (the "Event"), I agree to the following:
1. Voluntary participation. I am participating voluntarily. I am in good physical health and have no medical condition that would prevent me from safely playing pickleball. I have consulted a physician if I had any doubt.
2. Assumption of risk. I understand that pickleball involves physical exertion and a risk of injury, including but not limited to sprains, strains, fractures, falls, collisions with players or equipment, being struck by a ball or paddle, eye injuries, heat exhaustion, heart attack, and in rare cases serious injury or death. I knowingly assume all of these risks, whether known or unknown.
3. Release and waiver. To the fullest extent permitted by law, I, for myself and on behalf of my heirs, executors, administrators, assigns, and personal representatives, hereby release, waive, discharge, and covenant not to sue Community Teams (the Organizer), MVP Holland (the Venue), PickleballTournaments.com, and each of their respective owners, officers, directors, board members, employees, staff, volunteers, sponsors, agents, successors, and assigns (collectively, the "Released Parties") from any and all claims, demands, losses, damages, liabilities, and causes of action of any kind, whether known or unknown, for personal injury, illness, permanent disability, death, or loss of or damage to property, arising out of or related in any way to my presence at or participation in the Event, including claims arising in whole or in part from the ordinary negligence of the Released Parties.
4. Indemnification. I agree to hold harmless and indemnify the Released Parties from any claims, costs, or expenses, including attorney fees, arising from my participation or conduct at the Event.
5. Medical treatment. I authorize Event staff to obtain emergency medical treatment for me if needed. I am responsible for any resulting medical costs.
6. Rules and conduct. I agree to follow all Event rules, facility rules of MVP Holland, and instructions from Event staff. I understand I may be removed from the Event, without refund, for unsafe or unsportsmanlike conduct.
7. Equipment. I am responsible for my own equipment, including appropriate court shoes. Protective eyewear is recommended.
8. Photo and video release. I grant Community Teams and MVP Holland permission to use photographs or video of me taken at the Event for promotional purposes, without compensation.
9. Refunds. Entry fees support Community Teams and are non-refundable except as stated in the Event's registration policy.
10. Severability. If any part of this agreement is found unenforceable, the remaining parts stay in full effect. This agreement is governed by the laws of the State of Michigan.
I have read this agreement, fully understand its terms, and sign it freely and voluntarily.
